Last updated: August 2026. These terms govern the supply of website design, development, hosting and care-plan services by Bespoke Sites to you, the client. By submitting a project brief, or by accepting a quotation, you agree to these terms.
In these terms, "Services" means the design, build, hosting, care-plan and related services described in a quotation. "Quotation" means the written proposal issued by us setting out the Services and fees. "Content" means text, images, logos, video, data and any other material you supply for use on your website. "Agreement" means the Quotation together with these terms.
A binding Agreement arises when you accept a Quotation in writing (including by email) and pay the first month's fee where required. Our Quotations remain open for acceptance for 30 days from their date. All prices are stated "from" and are itemised; the final price in a Quotation is the price you pay, subject only to changes to the agreed scope requested by you in writing.
We design and build websites from scratch — never from templates. Each build includes hosting, security, maintenance and agreed content edits within the flat monthly rate. Unless otherwise stated in the Quotation, the Services exclude the creation of original photography, copywriting beyond agreed amounts, and third-party licence fees.
Set-up is free. The first month's payment covers hosting and the domain name. Thereafter a single flat monthly rate is payable in advance by direct debit, standing order or bank transfer on the first day of each calendar month. Fees are exclusive of VAT where applicable. We may increase the monthly rate once per twelve-month period by giving you 30 days' written notice; any increase will reflect the reasonable costs of hosting, maintenance and support.
Website plans carry a minimum term of six months from the date the website goes live, after which the Agreement continues month-to-month. Either party may terminate by giving 30 days' written notice. On termination, we will release to you the domain, content and accounts you own, and provide reasonable assistance with transferring hosting, subject to payment of all sums due. Where you terminate within the minimum term, the balance of the minimum term remains payable.
You will provide accurate information in your project brief, supply Content and approvals promptly, and ensure you have the rights to any Content or third-party accounts you supply. You will keep secure the login credentials for accounts we set up in your name and notify us immediately of any unauthorised use.
You own your domain name, your Content and your third-party accounts at all times. We assign to you the copyright in the finished website on full payment of all sums due. We retain ownership of underlying design systems, tools and software we create in the course of our work, and grant you a perpetual, royalty-free licence to use them as part of your website. You grant us a licence to reference your website in our portfolio and case studies unless you object in writing.
We will perform the Services with reasonable skill and care. We warrant that the website will operate in accordance with the specification in the Quotation, and we will remedy defects notified to us within a reasonable time. We are responsible for maintaining adequate security on the hosting we provide, and we will make back-ups of your website on a regular basis.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law. Subject to that, our total liability to you arising out of or in connection with the Agreement, whether in contract, tort (including negligence) or otherwise, is limited to the total fees paid by you in the twelve months preceding the event giving rise to the liability. We will not be liable for any indirect or consequential loss, including loss of profits, revenue, data or goodwill.
Both parties will comply with UK GDPR and the Data Protection Act 2018 in relation to personal data processed under the Agreement. We process personal data on your behalf only to the extent necessary to provide the Services, and we maintain appropriate technical and organisational measures to protect it. Our Privacy Policy describes how we handle personal data we collect directly.
Neither party is liable for delay or failure to perform its obligations caused by events outside its reasonable control, including acts of God, strikes, power failures, network or infrastructure outages, or failure of third-party services.
If you have a complaint, please email hello@bespoke-sites.co.uk with the subject line "Complaint". We will acknowledge receipt within two working days and aim to resolve the matter within 14 days.
These terms and the Quotation constitute the entire agreement between the parties and supersede any prior representations or correspondence. The Agreement shall be governed by and construed in accordance with the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
